4 arrests made in shooting death of Fargo teen

Fargo Police say four men have been arrested in connection with the May 22nd shooting death of 16-year-old James Moore — and they say the incident was an apparent drug robbery.

Last Thursday, police arrested 31-year-old Marcus Rexrode of Fargo. He is charged with Class A felony murder, conspiracy to deliver a controlled substance, felon in possession of a firearm, and driving under suspension.

Today (Wed), police identified three others arrested:

41-year-old Marcus McCuin of Fargo is charged with class AA felony murder, conspiracy to commit robbery, felon in possession of a firearm and tampering with evidence.

19-year-old Fabian Scott of West Fargo is charged with class AA felony murder and conspiracy to commit robbery.

36-year-old Tommie Trent of Moorhead is charged with conspiracy to deliver a controlled substance.

Fargo Police Capt. Bill Ahlfeldt explained that in North Dakota, it is considered murder to take part in serious offenses such as robbery, resulting in the death of someone involved in the robbery. He said people “can be charged with murder without actually committing the act of killing the victim, by taking part in the incident which led to it.”

Ahlfeldt added: “This portion of North Dakota Century Code was taken into consideration when placing some of the charged in this case under arrest.”

Police Chief Dave Zibolski said there could be more arrests in the case.
