An appeal by the Boardwalk Bar and Grill challenging a temporary injunction over an executive order prohibiting dine-in services has been rejected by the Court of Appeals. The court ruled the December 22nd filing “moot” because the executive order is no longer in effect.
The Attorney General’s office filed legal action against the East Grand Forks eatery for opening on several days back in December despite the executive mandate due to COVID-19. That prompted the Minnesota Health Department to serve Boardwalk with a cease and desist order.
In the ruling the Court of Appeals stated that Boardwalk has an opportunity to litigate the issues. A motion hearing in Polk County Court is set for April 14th.
