
The U-S Labor Department says 52 workers at a Bismarck-based security services firm will be getting more than $186,000 in back wages.
An investigation by the Department’s Wage and Hour Division revealed that the company, 10-Code LLC, violated overtime provisions of the Fair Labor Standards Act “by paying salary for all hours worked, and straight time for overtime.”
Chad Frasier, director of the Wage and Hour Division District in Denver, said: “Business operators cannot casually decide to pay workers as salaried, without examining whether or not they meet the salary exemption requirements.”
Frasier said, “By doing so, 10-Code LLC clearly violated federal laws by denying workers all their hard-earned pay.”
