UND issues response to hockey lawsuit

By Doug Barrett Aug 12, 2021 | 8:28 AM

The University of North Dakota has issued a brief statement in response to this week’s opinion by the 8th U. S. Circuit Court of Appeals regarding the dropped women’s hockey program.

The court revived a lawsuit filed by eleven former women’s hockey players alleging the school dropped women’s hockey in violation of Title IX laws.

In a request for comment by KNOX NEWS on Tuesday – and provided this morning (Thursday) – the University suggests the court decision does not reach the substance of the decision to eliminate the women’s program in 2017.  The statement goes on to say that the court “did not suggest UND’s decision was wrong but rather relied on a narrow textualist rationale in reversing the District Court.”   UND officials say they remain confident that the decision will be ultimately upheld.

The three judge panel ruled the athletes may be able to state an actionable Title IX claim.
