The 8th Circuit Court of Appeals has upheld a 15-year sentence for a Michigan (state) man found guilty on drug related charges in North Dakota.
In 2021 Larry Owens III was arrested after law enforcement found more than 5,000 fentanyl pills and cash in a Minot (ND) apartment. The drugs carried a street value of some $400,000 dollars.
At a hearing the district court exceeded the sentencing guidelines citing the “heightened risk of death with fentanyl” and Owen’s violent history. The sentence was longer than the eight years suggested by the defense and the nine-and-a-half year sentence recommended by the government.
The Appeals Court ruled the lower court did not abuse its discretion.
