Fatal police shooting in Mapleton ruled justified

North Dakota’s attorney general says officers were justified in their use of deadly force against a man police say was having a mental health crisis.

Attorney General Drew Wrigley held a news conference this morning (Monday) to discuss details of an investigation by the North Dakota BCI regarding the incident.

Authorities were called to the home on reports of an individual suffering a mental health issue.  When Cass County deputies arrived on scene they heard gunshots.

Wrigley says after an hours-long standoff Andrew Martinez opened the front door with a firearm.  “At that moment the muzzle of the weapon was pointed skyward.  He was holding it.  He opened the glass door and lowered the AR-15 and pointed in the direction of the officers.”

Four officers fired over 20 rounds striking Martinez five times.  Several guns were located inside the home.

Wrigley says he briefed family members about the BCI findings on Friday.
