ND lawmakers looking to increase “huffing” penalty

North Dakota lawmakers are looking to increase the penalty provision for repeat offenders caught inhaling vapors or “huffing” to get high.

Supporters say the enhanced penalty is not designed to throw people in jail but to get help to those violating the law.   The bill would move the offense from a Class “B” to a Class “A” misdemeanor.

Representative Shannon Roers-Jones says it would impact anyone convicted of “huffing” three times within a year.  “That would make them eligible for supervised probation and require a substance use evaluation.”

The measure was approved on a 78-16 vote.
