ND High Court denies GF man’s request for post-conviction relief

The North Dakota Supreme Court has upheld a lower court ruling denying an application for post-conviction relief by a Grand Forks man serving 20 years for gross sexual imposition.

George Lyons, who was convicted after a 2018 jury trial, argued that his legal counsel was ineffective, because his attorney opted not to impeach the victim about a previous unrelated sexual assault report.

The district court found that the attorney discussed his trial strategy with Lyons…and ruled that Lyons failed to prove ineffectiveness.

The Supreme Court unanimously affirmed that ruling.
