Fufeng opponents not ready to give up

Opponents of the proposed Fufeng project in Grand Forks hope to take their case to the North Dakota Supreme Court.

The group has filed a notice of appeal with the state’s high court over a lower court ruling supporting the city’s rejection of petitions requesting a public vote on the corn milling plant.

Construction activity surrounding Fufeng has been paused while the city awaits a ruling by the Committee on Foreign Investment in the United States as it relates to the purchase of land and the proximity of the China-based company to the Grand Forks Air Force Base.

City Administrator Todd Feland says  project bids won’t come before the council until March of next year.  Feland says the city is keeping an eye on the bottom line as engineering work continues.  “It’s less than $2 million dollars since we started this in February…so well within the $5 million dollar letter of credit.”

The CFFIUS report is likely to be issued in the next 30 to 60 days.
