Grand Forks officials aren’t too high on changes made by the North Dakota legislature to lessen criminal penalties for possession of marijuana. City Attorney Howard Swanson urged the city council this week to amend local laws to comply with new state guidelines. Swanson says the move is to avoid confusion between municipal and district courts. The change treats the crime as a misdemeanor – regardless of amounts.Police Chief Mark Nelson says the legislative decision caught a lot of law enforcement off guard.
The change effects “possession” only and does not impact those charged with intent to deliver.
Council President Dana Sande says he finds irony with all the talk of opioid addiction that the state is reducing penalties for illicit drugs.
