The North Dakota Supreme Court will take up the appeal this afternoon of a Grand Forks couple who claim the owner of a home where drugs were sold should be liable for the death of their 18-year old son. Keith and Debra Bjerk asserted negligence claims against Kenton Anderson. In 2016 a district court granted Anderson’s summary judgement motion and dismissed the claims.
In the appeal the Bjerks will argue that “genuine issues of material fact exist” whether Anderson retained control over the premises where dangerous illegal drugs were fatally administered to their son. Christian Bjerk died in June 2012.
The state’s high court will hear the case at 2:45 p-m.
