A motion to dismiss the lawsuit over the Arbor Park election has been moved up to this week. A handful of park supporters filed a legal challenge against the city of Grand Forks over the June election allowing the pocket park to be turned into a five story condo complex. Voters narrowly approved the development project.
Critics question the use of a single voting site and the training of election officials. In response – the city has filed a motion to dismiss. The motion was originally set for a court date on September 22nd.
The case will be heard (Tuesday) by East Central Judge Steven Marquart of Fargo.
