Arbor Park Court Challenge

A decision on whether to dismiss the legal challenge in the Grand Forks / Arbor Park lawsuit is expected this morning. Supporters of the downtown pocket park are challenging the city over the recent election which paves the way for developing the site into a five story condo complex. District Judge Steven Marquart of Fargo is hearing the case in Grand Forks.
Attorney Ron Fisher - who represents the city - says those bringing the court challenge missed specific filing deadlines. Attorney Henry Howe countered that technical issues have little impact on the actual facts in the case. Judge Marquart is expected to issue a ruling around mid-morning on whether to allow today’s scheduled hearing to continue.
Meanwhile… city staff continued to move art out of the park on Tuesday in preparation for project construction.
