A court date has been set in the Arbor Park case challenging aspects of the June election. A motion to dismiss the legal challenge is set before District Judge John Thelen on September 22nd.
In June voters narrowly approved allowing the pocket park to be developed into a five story condo complex.
A handful of park supporters filed a legal summons earlier this month in an attempt to stop the project. They challenge the use of a single voting site and the training of election officials. In response - the city filed the motion to dismiss.
Last week the city issued a statement urging residents and organization who placed extra” art in the park to remove it by next Tuesday. City sponsored art will be stored and moved to other locations at some future point.
