Arbor Park Appeal

Supporters of Arbor Park have filed a Notice of Appeal with the North Dakota Supreme Court over city plans to develop the downtown pocket park. The decision follows a District Court ruling in August that allowed the five story condo complex to proceed. The lawsuit challenged the use of a single voting location and the rejection of two absentee ballots.
Officials with the North Dakota Supreme Court say they received the Notice of Appeal but have not assigned it a case number because the required filing fee has not been paid. The plaintiffs have until September 17th to pay 125 dollars – the standard amount in a civil case.
City Administrator Todd Feland says he’s disappointed by the
decision but the project is moving forward.
Feland says Dakota Commercial
owns the property and the city remains confident in its case.
